If you are already in the United States and are unable or unwilling to return to your home country because of persecution or well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion then you may be eligible for asylum. If you are eligible for asylum then you may be permitted to remain in the United States until a final decision is made on your case. You may also apply for employment authorization during the time your case is being reviewed by USCIS if certain requirements are met.
